Process

How buying in Mexico works.

The steps are different from California, but straightforward with the right team.

01

Choose & visit

Narrow down the region, tour properties with Astamar Realty and get pre-qualified for U.S.-dollar financing if you need it.

02

Offer & agreement

Agree on price and terms, then sign a promissory purchase agreement with a deposit, usually held in escrow.

03

Trust & permits

In the restricted zone, a Mexican bank sets up your fideicomiso and the foreign-investment permit is obtained.

04

Close with a notario

The notario público verifies title, calculates taxes and records the deed. You receive your keys.

The fideicomiso

Not a lease — real, secure ownership.

Near the coast and borders, foreigners own residential property through a fideicomiso, a bank trust created under Mexican law. The bank holds title as trustee; you are the beneficiary with the right to live in, rent, improve, sell or pass on the property.

The trust runs for 50 years and is renewable. The "99-year lease" you may have heard about is a myth.

Due diligence

What we check before you buy.

  • Clear private title (not ejido land)
  • Certificate of no liens
  • Condominium rules and HOA fees
  • Property tax (predial) and utilities paid up
  • Local vacation-rental rules
  • Permits for new construction and pre-sales
  • Estimated closing costs (about 5%–8%)
  • Financing plan and exchange-rate exposure

Questions

Buying in Mexico FAQs

Yes. Within the "restricted zone" — 50 km (about 31 miles) from the coast or 100 km from a border — foreigners hold residential property through a fideicomiso, a bank trust. Outside the restricted zone, such as in Mérida, foreigners can generally hold title directly with a foreign-investment permit.
